Sorry to Bother You, But the Bird Feeder is Empty



Why is that you can barely get phone service in Sealy, but ISIS uploads videos from holes in the ground in the desert.


Does anyone else worry that internet purchasing will do away with retail stores?  The Galleria would not be profitable if it was just a big skating rink.

Oh, I'm just fine, sharp as ever and still at it. That decomposing smell has not yet adversely affected my work nor my golf.

Never had a bad trip to New York City. Mostly met wonderfully nice people and a photographer's paradise for street photography.  The hotel I stayed at was once the home of Carey Grant and I won't do that again.  It became annoying, because Carey and I look so much alike,when the staff walked by me they would always say "Judy, Judy, Judy."

Texas trooper fired, allegedly propositioned driver for sex

SAN ANTONIO (AP) - A Texas trooper has been fired after being accused of stopping a driver for speeding and offering her $300 to have sex with him.
The Texas Department of Public Safety on Tuesday announced the dismissal of Christopher Champion just hours after his arrest and release.
The 31-year-old Champion was arrested Monday night in San Antonio on charges of misdemeanor soliciting prostitution and official oppression.
Online Bexar (bayr) County jail records don't list bond or an attorney to speak for Champion, who joined DPS in 2008 and was stationed in San Antonio.
Investigators say Champion on Sept. 17 stopped a woman on Interstate 35, allegedly tried to solicit sex and then used her cellphone to text himself, to get her contact information.
She left without getting a ticket but contacted Texas Rangers.

His felonious conduct? Passing out fliers about jury nullification rights on the sidewalk of the Mecosta County courthouse. The fliers from the Fully Informed Jury Association describe juror rights that some complain are omitted by judges and prosecutors in explaining jury service before trial.

After 11 years of litigation, the onetime owner of an Internet company can finally reveal what kind of information the FBI had sought about one of his customers.
A federal judge has lifted a gag order that had prevented Nicholas Merrill from revealing the contents of the national security letter demanding the information, report the Washington PostU.S. News & World Report, the New York Times, the Register andArs Technica. A press release is here.
Merrill is the first person who can reveal the entire contents of such a letter, according to the Washington Post.
U.S. District Judge Victor Marrero of Manhattan had ruled (PDF) in August that the government had no good reason to keep the letter’s contents secret, since other government agencies had already revealed the type of information sought in such letters. Marrero stayed the order for 90 days to allow the government to appeal, but the Justice Department did not file one. His opinion went into effect Monday.
Merrill told the Washington Post he was shocked in 2004 when an FBI agent handed him the national security letter, used to seek customer records without court approval. The letter barred Merrill from revealing he had received the letter, the identity of the customer targeted, and the contents of the letter. Despite the secrecy demanded by the letter, Merrill contacted the American Civil Liberties Union and sued under the name “John Doe.”
The FBI withdrew its demand for the data in 2006 but continued to support a gag order. In 2010, Merrill won the right to identify himself, but a gag order on the contents of the letter remained. Merrill sued again in 2014 with the help of a Yale Law School’s Media Freedom and Information Access Clinic, resulting in the new decision.
Among the information sought about the customer and his account were associated addresses and telephone numbers; screen names; merchandise orders; associated physical, email and Internet protocol addresses; and “any other information which you consider to be an electronic communication transactional record.” Merrill believes the order could be interpreted to include web browsing history.
“The FBI has interpreted its NSL authority to encompass the websites we read, the web searches we conduct, the people we contact, and the places we go,” Merrill said in the press release. “This kind of data reveals the most intimate details of our lives, including our political activities, religious affiliations, private relationships, and even our private thoughts and beliefs.”

Albert Hinojosa died of complications from heatstroke while he was incarcerated at the Garza West Unit of the Texas Department of Criminal Justice.  Hinojosa's mother and sole heir, sued, asserting claims under 42 U.S.C. § 1983 against numerous prison officials and employees, and the TDCJ, alleging that they were responsible for her son's death.  In this interlocutory appeal, defendants challenged an order of the District Court that deferred ruling on their motion to dismiss on the basis of qualified immunity and ordered limited discovery.   A panel majority of the Fifth Circuit decides that because the District Court correctly concluded that the complaint was sufficient and that further factual development was needed to rule on defendants' qualified immunity defense, and because the discovery that the District Court ordered was narrowly tailored to the facts needed to rule on the defense, the Court is without jurisdiction.  Consequently, the majority dismisses the appeal.  A dissent finds the majority's opinion "indefensible," explaining its reasons for believing that qualified immunity is due these officials as a matter of law and that the pleadings fail to state a claim under Rule 12(b)(6) under Iqbal.
