My Daughter's Birthday is Today

Lawyers. Of the 56 signers of the Declaration of

Independence, 25 were lawyers.  Of the 55 framers of the

Constitution, 32 were lawyers.

We want our children to learn how to become President so Trump Presidential library to contain all his appearances on Howard Stern show (the guy famous for contests of throwing slices of bologna at women and such).  Classy path to Presidency.

DAILY COMMENTARY - March 11, 2016

Before STEWART, Chief Judge, OWEN, and COSTA, Circuit Judges.

REVERSED and REMANDED. (March 2, 2016).

Alleging that he was fired in retaliation for reporting that his coworkers made racial comments based on his being in an interracial relationship, plaintiff brought the underlying suit against his employer claiming a violation of Title VII.  His employer, in reliance on an Arbitration Plan contained within its employee handbook, moved to compel arbitration.  Plaintiff opposed the motion, arguing that the Arbitration Plan was illusory because it failed to include a savings clause related to existing claims and disputes and requiring advance notice of termination.  Disagreeing with plaintiff, the District Court granted the employer's motion to compel arbitration.  The Fifth Circuit reverses, holding that the employer's retention of the unilateral power to terminate the Plan without advance notice to employees renders the Plan illusory under a plain reading of Lizalde v. Vista Quality Markets, 746 F.3d 222 (5th Cir. 2014).

On Appeal from the United States District Court for the Northern District of Texas (Reed Charles O'Connor).
Attorney for Appellant - Rory Divin, Fort Worth, TX
Attorney for Appellee - Judith Sadler, Houston, TX

My wonderful daughter's birthday is today.  It was really nice of the people at the small art museum she works at in Galveston to throw her a little party.  I'm so happy that her life is finally all coming up roses and that I lived to see it.  It seems like yesterday we brought her home from Rosewood Hospital. She has brought me much joy throughout her entire life.  I only wish her Mom could see what a fine person our daughter is.

Want America to look like this?  Keep voting Republican.  ISIS won't destroy America if  our leaders get Americans to hate Americans.  We'll just do it to ourselves.
